We really have two types of contracts that are commonly used in Florida real estate transactions. The first is the Contract for Residential Sale and Purchase, known as CRSP. The second is the "As Is" Residential Contract for Sale and Purchase, commonly called the "as is" contract. What is an Inspection Period? In real estate, an inspection period is the timeframe during which buyers have the opportunity to perform their due-diligence on the piece of property they intend to buy. It gives buyers an opportunity to inspect the property, and if it doesn t meet their standards, they can either cancel the contract, or renegotiate the terms. If the contract is canceled, the buyer doesn t lose money in the process. The procedure is much simpler under the AS IS contract. Seller has no obligation to repair anything, but buyer can cancel the contract within the inspection period if buyer determines the property is not acceptable. There are a couple other notable differences between the two contracts pertaining to inspections and repairs. Florida Realtors has three residential contracts, only one of which contains this subjective “out” for buyers during the inspection period. The other two contracts contain repair limits for sellers with regards to any contractually-required repairs that may need to be made based on an inspection report. The inspection period is a negotiated time frame in which buyers have the opportunity to conduct their due-diligence on the property. The purpose is to give the buyers a “free look,” so to speak. If the buyers don’t like what they see, they can re-negotiate the terms of the contract, or cancel the contract altogether and have their earnest money returned without penalty.

Ironically, if the agreement called for a 7-day inspection period, the contingency would end a day EARLIER, on Wednesday. Why? Because according to the contract?s computation of time, any period greater than 5 days includes all days (but still must end on a business day). So in this example, a 7-day period is actually less than a 5-day.
